1. Overview

These Terms of Service (“Terms”) govern the online store operated by Fukushima Watch Company Co., Ltd. (“Fukushima Watch Company,” “we,” “our,” or “us”) at shop.fukushima-watch.com (“Site”).

By accessing or purchasing from the Site, you agree to be bound by these Terms and all referenced policies. If you do not agree, please refrain from using the Site.

Nothing in these Terms limits any mandatory consumer rights that may apply under applicable law, including statutory rights available to consumers in the European Union.

2. Definitions

“Customer” means any individual or entity that browses or purchases Products on the Site.

“Products” means wrist-watches, accessories, and related items offered for sale by Fukushima Watch Company.

“Business Days” means Monday to Friday, excluding Japanese national holidays. We may announce additional closures, such as year-end and New Year holidays, on the Site in advance.

“EU Consumer” means a consumer located in the European Union who purchases Products from the Site for purposes that are outside their trade, business, craft, or profession.

3. Acceptance & Modification of Terms

Fukushima Watch Company may revise these Terms at any time. Changes become effective immediately upon posting, unless otherwise stated.

Continued use of the Site constitutes acceptance of the revised Terms. Please review this page periodically.

Changes to these Terms do not affect any rights that cannot be excluded or limited under applicable law.

4. Eligibility

You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to make a purchase.

If you are under the age of majority, you may use the Site and purchase Products only with the consent and involvement of a parent or legal guardian.

5. Products & Pricing

All product descriptions and prices are subject to change without notice.

We strive for accuracy, but typographical, pricing, or system errors may occur. Fukushima Watch Company reserves the right to cancel or refuse any order containing such errors, to the extent permitted by applicable law.

Product images are for reference only. Colour, texture, or appearance may vary due to monitor settings, lighting, natural material differences, or production variations.

Prices may be displayed and/or charged in the currency shown at checkout, depending on your location, payment method, and settings. If your payment is processed in a different currency, the final charge in your local currency depends on your card issuer’s exchange rate and any applicable fees.

6. Orders & Payment

Your online order constitutes an offer to purchase. Acceptance occurs only when we dispatch the goods and send a shipping notification email, unless otherwise required by applicable law.

We accept the following payment methods, where available:

  • Visa, MasterCard, JCB, and American Express via Shopify Payments

  • Shop Pay, Apple Pay, and Google Pay

  • PayPal

  • KOMOJU — Japan Bank Transfer

  • KOMOJU — Smartphone Payments, including LINE Pay and PayPay

Payment is captured immediately at checkout.

If payment fails, is reversed, or cannot be verified, we may cancel the order without liability, to the extent permitted by applicable law.

Once an order has been confirmed or processing has begun, cancellation requests may not be accepted, except where the EU right of withdrawal or other mandatory consumer rights apply, or where we agree at our discretion before dispatch.

7. Shipping & Delivery

Dispatch times, carriers, transit estimates, taxes, duties, and delivery conditions are set out in our Shipping Policy.

Please ensure that your shipping address, phone number, and email address are accurate at checkout.

Subject to any mandatory consumer rights that may apply, title to the Products and risk of loss or damage pass in accordance with applicable law.

For consumer orders where Fukushima Watch Company arranges delivery, risk of loss or damage generally passes to the Customer when the Customer, or a third party indicated by the Customer other than the carrier, physically receives the Products.

If the Customer independently arranges a carrier that was not offered by Fukushima Watch Company, risk may pass when the Products are handed over to that carrier, to the extent permitted by applicable law.

8. Customs, Duties & Taxes

For United States DDP orders, import duties and taxes are calculated and collected at checkout where applicable, and no additional duties or taxes should be due upon delivery in principle.

For all other international destinations, including Canada, Mexico, the European Union, and the United Kingdom, orders may be subject to import duties, VAT, taxes, customs charges, and brokerage or clearance fees. Unless otherwise stated at checkout, these charges are the Customer’s responsibility and may be collected before or upon delivery.

Fukushima Watch Company is not responsible for delays, charges, or procedures imposed by customs authorities, carriers, or local tax authorities, except where required by applicable law.

If a parcel is refused, unclaimed, or returned due to unpaid import charges, we may deduct any return shipping, customs, handling, storage, or related charges from any refund, to the extent permitted by law.

9. Manufacturer’s Warranty

At present, the manufacturer’s warranty is provided for Japan domestic sales only.

Warranty coverage does not include normal wear and tear, accidental damage, misuse, improper bracelet resizing, or unauthorised repairs.

This section does not limit any mandatory consumer rights that may apply under applicable law.

10. Returns, Refunds & Right of Withdrawal

Return eligibility, procedures, deadlines, refund rules, and EU withdrawal procedures are explained in our Return & Refund Policy.

Except where mandatory consumer protection laws apply, we accept return requests within 7 days of delivery only for defective, damaged, or incorrectly shipped Products.

We do not accept returns or exchanges due to customer preference, such as colour perception, size, or “changed mind”, except where the EU right of withdrawal or other mandatory consumer protection laws apply.

If you are a consumer located in the European Union, you may have the right to withdraw from your online purchase within 14 days from the day on which you, or a third party indicated by you, receives the goods, without giving any reason.

To exercise the EU right of withdrawal, please use the “Right of Withdrawal” link in the footer of our online store, or contact us at info@fwc.co.jp.

If you exercise the EU right of withdrawal, you must return the goods in accordance with our Return & Refund Policy. You may be responsible for the direct cost of returning the goods, unless otherwise required by law.

Returned Products, including resized bracelets, must be returned with all removed links, pins, parts, accessories, warranty cards, documents, and original packaging where applicable. Missing parts, scratches, signs of wear, or handling beyond what is necessary to inspect the Products may result in a deduction for diminished value, to the extent permitted by applicable law.

Cooling-Off Notice for Japan: Mail-order purchases are not subject to the cooling-off provisions under Japanese law.

11. User Accounts

You may create an account to view order history and save shipping information.

You are responsible for keeping your login credentials confidential and for all activity under your account.

Fukushima Watch Company may suspend or delete accounts that violate these Terms, our policies, or applicable laws.

12. Prohibited Conduct

You agree not to:

  • Use the Site for unlawful, fraudulent, or abusive purposes

  • Upload viruses, malware, or harmful code

  • Infringe the intellectual property rights of Fukushima Watch Company or any third party

  • Conduct data mining, scraping, or automated access without our consent

  • Interfere with the security, availability, or operation of the Site

  • Purchase Products for unauthorised resale, diversion, or export in violation of applicable laws

13. Intellectual Property

All content on the Site, including text, images, graphics, logos, product names, designs, and trademarks, belongs to Fukushima Watch Company or its licensors and is protected by Japanese and international intellectual property laws.

You may not reproduce, distribute, modify, or use any Site content without our prior written permission, except as permitted by applicable law.

14. Third-Party Services & Links

The Site may link to external websites or integrate third-party services, including payment processors, shipping providers, analytics tools, fraud prevention tools, and Shopify apps.

Fukushima Watch Company is not responsible for the content, terms, security, or privacy practices of third-party websites or services.

Use of third-party services may be subject to their own terms and privacy policies.

15. Site Availability & Force Majeure

We aim to keep the Site operational, but scheduled maintenance, technical issues, network outages, carrier disruptions, natural disasters, strikes, government actions, customs delays, or other events beyond our control may cause temporary interruptions or delays.

Fukushima Watch Company shall not be liable for any loss or damage arising from such interruptions or delays, to the extent permitted by applicable law.

16. Disclaimer of Warranties

Except as expressly provided in the Manufacturer’s Warranty above or as required by applicable law, the Site and Products are provided “as is” and “as available” without warranties of any kind, express or implied.

To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Nothing in this section excludes or limits any statutory warranty, conformity right, or mandatory consumer protection right that may apply under applicable law.

17. Limitation of Liability

To the maximum extent permitted by law, Fukushima Watch Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Site or purchase of Products, even if advised of the possibility of such damages.

In any event, our total liability shall not exceed the amount you paid for the applicable order, except where such limitation is prohibited by applicable law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, intentional misconduct, gross negligence, or mandatory consumer rights where applicable.

18. Indemnification

You agree to indemnify and hold harmless Fukushima Watch Company, its directors, employees, contractors, and affiliates from any claim, demand, loss, liability, damage, or expense, including reasonable legal fees, arising from your breach of these Terms or violation of any law or third-party right.

This section applies to the extent permitted by applicable law and does not limit any mandatory consumer rights that may apply.

19. Governing Law & Jurisdiction

These Terms are governed by Japanese law.

Any dispute shall be submitted to the exclusive jurisdiction of the Fukushima District Court, Japan, unless otherwise required by mandatory applicable law.

For consumers located in jurisdictions where mandatory consumer protection laws apply, nothing in this section deprives the consumer of protections or rights that cannot be waived by contract.

20. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Shipping Policy, Return & Refund Policy, Privacy Policy, and Legal Notice, constitute the entire agreement between you and Fukushima Watch Company regarding use of the Site and purchase of Products, and supersede all prior communications.
